The government fees are small. What you spend them on is what actually determines whether the trust works
Ask around, and you will hear wildly different numbers for what a family trust costs in Kenya. Most of that confusion comes from conflating two very different things: what the government charges, and what it costs to get the trust deed right.
The Statutory Fees Are Genuinely Modest
Registering and incorporating a trust in Kenya is not, at the government-fee level, expensive. Once the trust deed is drafted, the costs run roughly as follows.
- Name reservation on the registration portal — around Kshs 150.
- Stamp duty assessed on the trust deed at the Lands Registry — a nominal Kshs 200.
- Incorporation fee for the Certificate of Incorporation under the Trustees (Perpetual Succession) Act (Cap 164) — Kshs 10,000, following the fee revision that raised this from the previous Kshs 3,000.
- Gazette Notice publication — typically Kshs 2,000 to 5,000.
Altogether, the pure statutory outlay to incorporate a trust sits in the region of Kshs 12,000 to 15,000. If that were the whole story, every family would have a trust already.
The Real Cost Is Getting the Deed Right
The trust deed is the single document that decides everything the trust will ever do — who the trustees are, what powers they hold, how beneficiaries are defined, how disputes are resolved, and what happens on the death or incapacity of a trustee or the settlor.
A poorly drafted deed is not a cheaper trust; it is an expensive dispute waiting to happen, and the legal fees to unwind a defective trust years later dwarf what proper drafting would have cost at the outset.

Incorporating the trust gives it legal personality — but an empty trust protects nobody. Actually transferring assets into the trust’s name, particularly land, triggers its own transaction costs: stamp duty on the transfer itself (assessed separately from the nominal deed-stamping fee), valuation costs, and registration fees at the relevant land registry. Families frequently budget for incorporation and forget to budget for funding the trust. |
What Drives the Total Cost in Practice
- How many and what kind of assets are being moved into the trust — a single family home is a very different exercise from a portfolio of land parcels and business shareholdings.
- Whether you use a professional trustee, which carries ongoing trustee fees, versus family members as trustees, which carries no fee but different risks.
- How many trustees and beneficiaries need to be documented and verified with the registrar.
- Whether the trust needs to interact with an existing business structure, which adds a layer of company and tax advice.
Timeline Affects Cost Too
The incorporation process, run through the Business Registration Service, generally takes a few months from name reservation to certificate — faster than it once did, now that the process has been centralised and modernised.
Rushed drafting to meet an artificial deadline is one of the most common causes of a defective deed, so building in realistic time is itself a cost-saving decision.
